1. Acceptance of Terms
By accessing our website at https://divastouchdining.com/, scheduling a consultation, or retaining Diva's Touch, Inc. for culinary services, you agree to be bound by these Terms of Service. By using these services, you represent that you are at least 18 years of age.
2. Services
Diva's Touch, Inc. provides executive-focused private culinary experiences, including but not limited to corporate lunches, private dinners, and event catering. All services are subject to the terms of the specific Proposal and Executive Corporate Event Agreement signed by the Client.
3. Booking, Payments, and Cancellations
- Retainer: A 50% non-refundable retainer is required to secure any event date. This secures event date reservation, menu development, and procurement scheduling.
- Final Payment: The remaining balance is due no later than five (5) calendar days prior to the scheduled event date. If booked within 5 days of the event, full payment is due at booking.
- Cancellation Policy: The retainer is non-refundable. Failure to remit final payment by the deadline may result in cancellation without refund of the retainer.
- Guest Count Overage: Final guest count must be confirmed five (5) days prior to the event. Increases in guest counts will be billed at the applicable per-guest rate.
4. Liability & Disclaimers
- General Liability: Diva's Touch, Inc. shall not be liable for damages resulting from guest misconduct or force majeure events.
- Alcohol Policy: The Client is responsible for providing all alcohol and ensuring compliance with local licensing laws.
- Carrier Liability: Regarding mobile communications, carriers are not liable for delayed or undelivered messages.
5. SMS & Mobile Communication
Diva's Touch, Inc. uses SMS to provide high-touch service updates. Use cases include but are not limited to: appointment reminders, consultation confirmations, proposal notifications, and service-related alerts.
- Consent: By providing your phone number, you consent to receive these communications. Consent is not a condition of purchase.
- Rates: Message and data rates may apply.
- Frequency: Message frequency varies based on your event schedule and interactions with us.
- Opt-Out: You may reply STOP to any text message to cancel or unsubscribe at any time.
- Support: Reply HELP for assistance or contact our support team at the email below.
6. Privacy Policy
Our collection and use of your data are governed by our Privacy Policy. By using our services, you also agree to the terms outlined therein.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions.
